Box 612 <br />Paonia, CO 81428 <br />Re: Remaining Structures and Materials at the Hawk's Nest Mine, West Mine Area <br />Dear h1r. Drew: <br />The construction contract for the first phase of the state reclamation work <br />at the Hawk's Nest Mine will be let within the next three weeks. This letter <br />constitutes official notice by the Colorado Mined Land Reclamation Division <br />to you as agent for Western Slope Carbon, Inc. that any and all structures, <br />facilities and other mining related materials remaining on the West Mine area <br />site after 10:00 a.m. on November 7, 1989 (pre-bid meeting time) must remain <br />on the site thereafter and cannot be sold or otherwise removed or damaged in <br />anyway. The contract scope of work for structural demo]ition work and <br />associated salvage value as calculated by bidders prior to the bid opening <br />becomes fixed at that time. Removal of or damage to any of the above <br />referenced features subsequent to that time may have an adverse effect on <br />the competitive bidding process and may cause significant financial harm to <br />the successful bidder, This in turn may require legal action by the state <br />Attorney General's office against Ylestern Slope Carbon, Inc. and/or it's agent <br />to correct the problem. <br />You are reminded that Western Slope Carbon, Inc. has on two separate occasions <br />via certified mail been given notice of deadlines for having all structures <br />and materials desired for salvage to be removed from the site.
