As you know, this year (2006) is Year Ten (lOj <br />of the 10 Year Reclamation Liability Period for the Harr Mine. As such, Energy <br />Fuels!Kerr considers Year 10 a milestone in regards to the Matr reclamation project and <br />feels that Yeaz 10 of the Reclamation Liability Period is a major juncture in finalization <br />of reclamation requirements and initiates the Final Bond Release process. I wilt add that <br />Energy Fuels has been diligent in meeting reclamation requirernettts throughout the <br />liability period. During the current year, reclamation of Pond "G", north of County Road <br />12E has been completed, Pond "C", adjacent to the shop ihcilities has been reclaimed and <br />to date, the Colorado State Water Engineer has stated verbally that we are to receive their <br />letter forthwith approving Pond "F's permanence as requested. Additionally, vegetation <br />sampling has been completed, weed spraying done as well as road, ditch and erosion <br />control maintenance. <br />Of our concern is the remaining task of sealing of the remaining monitor wells at <br />the mine site and Loadout Site. Energy Fuels much prefers to complete sealing of the <br />monitor wells this year (2006) in order to caaclude all of the `known' required tasks <br />during Year 10, Previously, you have stated that the Division is concerned that Energy <br />Fuels may be at risk for water monitoring if the wells are sealed/reclaimed prior to <br />complete approval for final bond release. As we understand it, in the event that Final <br />Bond Release was not approved for reasons unforeseen, therefore further water <br />monitoring of the wells could potentially be required. <br />We appreciate and respect the opinion of the Division of this concern and are <br />reluctant to proceed with sealing of the wells without the approval of the Division, <br />
