-53- <br />STIPULATION NU. <br />WITHIN UNE MONTH OF PERMIT ISSUANCE,THE PERMITTEE WILL SUBMIT TO <br />THE DIVISION A PLAN FOR REGULATING PUBLIC ACCESS ALONG STATE <br />HIGHWAY 133 DURING BLASTING IN ORDER TO PROTECT THE PUBLIC. NO <br />BLASTING SHALL OCCUR UNTIL AN ACCEPTABLE PLAN HAS BEEN SUBMITTED TO <br />AND APPROVED BY THE DIVISION. <br />With acceptance of the above stipulation, the operation is in compliance <br />with the requirements of this section. <br />XVI. Operations Description - Rules 2.05.2, 2.05.3(2) and 4.01 <br />The mine operations description is provided on pages 2.05-11 through <br />2.05-29 of the perniit application. The Hawk's Nest Mine is an <br />underground operation utilizing both retreating longwall and continuous <br />miners, dependiny on roof and floor conditions and coal seam thickness. <br />The "E" seam is currently being mined at Hawk's Nest. W.S.C. plans to <br />drive three rock tunnels to provide access for mining of the lower "Wild" <br />and "U" coal seams during the pe rniit term. The longwall is currently <br />operating in the West Mine, and all coal production at present is from <br />the West Portal. The maximum projected coal production during the permit <br />term is 1.5 million tons per year. Coal will be produced from Federal <br />Leases C-27103, D-042921, D-056724, and C-17130, and from U.S. Steel fee <br />coal leased to Western Slope Carbon. <br />Western Slope Carbon has requested, and the Division has granted, a <br />temporary cessation of operations for mining in the East Portal. Due <br />primarily to poor roof and floor conditions encountered in the "E" seam <br />at the East Mine, the longwall was pulled out of the East Mine and has <br />been operating in the West Mine "E" seam since April, 1982. W.S.C. does <br />not anticipate any further mining of the East Mine "E" seam during this <br />permit term. <br />The conditions which led to the cessation of operations in the East Mine <br />"E" seam had not been foreseen when the permit application was prepared. <br />As a result, the operations plan time frames and mine plan maps included <br />in the applicaton do not accurately portray the status of underground <br />operations at Hawk's Nest. As a result of cessation of mining at the <br />East Mine and increased production in the West Mine, it is anticipated <br />that the proposed rock tunnel development and mininy of the "Wild" and <br />"U" coal seams will commence earlier than projected in the application. <br />In order to update the status and projected timeframes for mining within <br />the East ana West Mine, "E", "Wild, and "D" coal seams, the following <br />stipulation is necessary. <br />STIPULATIUN N0. 12 <br />WITHIN 6 MUNTHS OF PERMIT ISSUNNCE, AND PRIOR TO ROCK TUNNEL <br />DEVELOPMENT, THE PERMITTEE WILL SUBMIT TU THE DIVISION REVISED MINE <br />PLAN MAPS AND MINING PROJECTIONS WHICH ACCURATELY REFLECT THE <br />CURRENT STATUS OF MINING AT HAWK'S NEST AND THE PROJECTED EXTENT <br />AND SEQUENCE OF MINING DURIfVG THE FIVE YEAR PERMIT TERM. <br />
