Water Riyhts and Replacement -Rules 2.04.7(3), <br />2.05.6 3 ii 2.07.6 d c and 4.05.15 <br />Western Slope Carbon has applied for and received a well permit for water <br />resulting from mine inflows (Appendix XIII-4) of the application. This <br />water right permits Western Slope Carbon to use 15.6 acre feet per year, <br />or 9.66 gallons per minute. This water right may be insufficient to <br />cover future inflow rates. The potential for injury to other water <br />rights holders exists when the mine shuts down and the mine pumps are <br />shut off, since inflows will continue until the mine workings fill. The <br />following stipulation is required to find the applicant in compliance <br />with Rule 2.04.7(3); Alternative Water Supply Information, Rule <br />2.U4.7(3)(a)(ii); Protection of Riyhts and Water Users, and Rule 4.05.15; <br />Water Rights and Replacement <br />STIPULATION N0. <br />AS MINING PROGRESSES IN ALL COAL SEAMS WITHIN THE HAWK'S NEST <br />hIINES, THE PERMITTEE WILL OBTAIN WATER RIGHTS TO ALL hIINE INFLOWS <br />TO INSURE NO INJURY IS INCURRED BY OTHER WATER RIGHTS HOLDERS <br />WITHIN THE BASIN OF THE NORTH FORK OF THE GUNNISON UPON THE <br />CESSATION OF hi1NING. THE DIVISION WILL BE SENT COPIES OF ALL <br />ADDITIONAL WELL PERMITS, CHANGE OF USE PERihITS, ETC. APPLIED FOR <br />AIJU/OR RECEIVED BY THE PERMITTEE. <br />IX. Probable Hvdrologic Conseouences of Mining and Cumulative <br />This Cumulative Hydrologic Impact Study (CHIS) for the drainage basin of <br />the North Fork of the Gunnison River has been prepared by the Colorado <br />Mined Land Reclamation Division ICMLRD) pursuant to Rule 2.07.6(2)(c). <br />This CHIS assesses the probable cumulative hydrologic impacts of all <br />anticipated coal mining operations upon the general area of the North <br />Fork of the Gunnison River Valley. Included in this assessment are all <br />existing coal mines and those proposed coal mines for which permit <br />applications have been submitted to the Division. This study has been <br />prepared using information and analyses contained in the Hawk's Nest Mine <br />permit application, information and analyses contained in other permit <br />applications for mines located in the general area and other available <br />information including site visitation by members of the Division staff. <br />Coal mining operations in the study area include: <br />1.
