-14- <br />Post-Mining Land Use is discussed on pages 2.05-56 and 4.16-1 of the <br />application. The proposed post-mining land use for the reclaimed areas <br />at Hawk's Nest is wildlife habitat. The land use is consistent and <br />compatible with adjacent land use. <br />Pursuant to Rule 2.07.6(2)(1), the post-mining land use of wildlife <br />habitat is hereby approved by the Division. The use will meet the <br />requirements of Rule 4.16. <br />III. Cultural and Historic Resources -Rules 2.04.4 and 2.05.6(4) <br />Cultural and historic resources information is presented on page 2.04-6 <br />of Volume 1 and in Appendix XI of Volume III. <br />Pursuant to Rule 2.07.6(2)(e), and on the basis of evidence submitted by <br />the applicant and consultation with the State Historic Preservation <br />Officer, the Division finds that the proposed mining operation will not <br />adversely affect any publicly owned park or place listed on the National <br />Register of Historic Places. <br />A cultural resources technical analysis (T.A.) has been completed by the <br />Office of Surface Mining (OSM). Although not required by the Act, <br />various federal laws require further consideration of cultural or <br />historic resources eligible for listing on the National Register of <br />Historic Places. The entire OSM Technical Analysis is included as <br />Attachment 1 to this findings document. <br />The proposed operation is in compliance with the requirements of this <br />section. <br />IV. Geology -Rules 2.04.5 and 2.04.6(2) <br />For a description of the geology of the mine area, please see the <br />"Description of the Hydrologic Environment" portion of Section IX <br />Probable Hydrologic Consequences of Mining and Cumulative Impact <br />oc <br />The geology sections of the permit applicaton, found on pages 2.04-7 <br />through 2.04-20, in Exhibits 2.04.6-A through P, and in Appendices XII <br />and XIII of the application have been reviewed by the Division for <br />compliance. Geologic cross-sections have been provided in Exhibit <br />2.04.5-C. Chemical analyses for the Wild seam and interburden to be <br />affected by proposed rock tunnels are included in Appendices XII-4 and <br />XII-5. All concerns pertaining to the geology description which were <br />raised in the Division's review have been satisfactorily resolved and the <br />proposed operation is in compliance with the requirements of this section. <br />The operation is in compliance with the requirements of this section. <br />
