In that conversation, we informed your office that an inspection of the Golden Eagle exhaust fan site had been performed on November 17, 1992. This inspection had been prompted by a citizen complaint received by Mr. Mike Ossola of the Las Animas County Planning and Land Use Office. Mr. Chazles Baldwin, in his complaint, worried about adverse effects from the methane e.~dlaust. Mr. Ossola and Mr. John Martinez, Las Animas County Health Department Inspector, inspected the site. Mr. Ossola was concerned enough about the condition of several nearby trees that he contacted this Division on November 5, 1992 resulting in the November 17, 1991 inspection. In a follow-up letter to Mr. Ossola, dated December 3, 1992 we stated that at the time of the inspection there had not been sufficient evidence to warrant a violation notice at that time. In a letter received by the Division on December 21, 1992, Mr. Jim Tatum, who owns the land upon which the exhaust fan site is located, was also concerned by the methane exhaust. During the course of a routine inspection on January 13, 1993, we noted that several trees in front of the exhaust fan had begtm to show signs of severe stress. This new information was related to Mr. Tatttm in a letter from the Division, dated January 19, 1993. At the same time, we contacted Mr. Arch Crouse of the Colorado Department of Health, who referred us to you. In the telephone conversation with your office on February 3, 1992, we were informed that the Colorado Department of Health had exempted this particular site from a methane emission permit, due to the Health Department's belief, at the time, that the methane posed no problem. It was also mentioned that you would, however, pursue the matter further.
