Box 1430 <br />Palisade, CO 81256 <br />RE: Road5~e Mine Follow-up for September InspLction (C-81-041) <br />Dear Mr. Reschke: <br />This letter is to notify you of follow-up activities by the <br />Division after the September joint inspection of the Roadside Mine <br />with OSM. Enclosed is a Notice of Violation related to the three <br />ponds for which emergency spillway modifications are required. The <br />Division received a technical revision application for pond <br />modifications on August 26, 1991 and is currently reviewing the <br />application, as you are aware. However, Powderhorn was notified in <br />May of this year that on-the-ground modifications of the ponds <br />would be required to be completed by September 1, 1991 (see the May <br />15, 1991 letter from Steve Renner to coal operators). Therefore, <br />Roadside Mine is currently not in compliance with the requirements <br />of the State program. <br />The Division also contacted the Colorado Department of Health <br />regarding the question about compliance with the mine's air <br />emission permit which was identified during the inspection. A copy <br />of the Division's letter to the CDOH is also enclosed. <br />A question about the mine's insurance was also raised during the <br />inspection. The Division requires that the cancellation <br />notification clause on the insurance certificate for the mine be <br />modified to indicate that MLRD will be notified if the policy is <br />modified or canceled. The certificate currently indicates that the <br />insurance company will endeavor to make such notification. I <br />understand that the renewal certificate for next year's policy is <br />currently in the mail. Please contact the insurance company <br />regarding this change and have a new certificate forwarded to the <br />Division. <br />
