There are channel reaches that SCC would like <br />to substitute the existing rock design with a TRM design. SCC will submit the TRM designs as an <br />addendum to the existing TR application. <br />If you have any questions or concerns regazding the postmine channel design issues identified above <br />please let SCC know. We plan to move forward with the TRM designs at the Seneca II, Yoast and II-W <br />Mines in the immediate future and anticipate an aggressive TR application submittal schedule so that we <br />can have the designs approved in time to allow for channel construction during the 2007 construction <br />season. <br />Additidnal Items discussed: - ~ " - - - - ' ~ ' - - -- -' '- <br />The Old Wolf Creek spoil at the Seneca II Mine was also discussed. SCC brought out some items <br />for you to consider, particularly the regulatory authority. It is SCC's contention that the pre-SMCRA <br />regulation of 1975 applies to this area. Therefore, the plan SCC is developing for the reclamation of <br />this azea need not be approved by the state in the foanal, post-SMCRA method. Please give this <br />some thought at give me a call concerning this. <br />The Phase I Bond Release Findings Document will be forthcoming for Yoast Mine. CDRMS <br />discussed the "floating" bond concept used at Yoast and discussed the "extra" bond SCC has in <br />respect to the additional channels required as a result of this bond inspection. <br />• It was requested that SCC prioritize our outstanding revision list so that review and approval can be <br />focused on the revisions SCC needs first. <br />Again, thank you for meeting with us yesterday and thank Sandy Brown, Janet Binns, and Jim Stark for <br />their time also.
