The Board concludes that the temporary relief sought <br />by Basin is consistent with the expressed legislative intent to <br />"allow for the continued development of the surface coal mining <br />operations in this state, while requiring those persons involved <br />in surface coal mining operations to reclaim land affected by <br />such operations ." Section 102 of the Act, Section <br />34-33-102, C.R.S.. <br />15. The Board further concludes that it has the authority <br />under the temporary relief provisions of Rule 2.07.4(3)(d) to al- <br />low Basin to continue to operate under the terms of existing per- <br />mits C-81-012 and C-81-013 during the 30-day public comment <br />period on the Division's proposed decisions renewing these per- <br />mits and/or until the March, 1994 monthly Board meeting should an <br />interested person request a formal hearing on either or both of <br />the proposed decisions. <br />AG File No. EEN9400036 <br />
