Mid-Term Review <br />Foidel Creek Mine - Permit No. C-82-056 <br />This document presents the results of the Division's Mid-term Review of the <br />Twentymile Coal Company's (TCC), Foidel Creek Mine. This review was conducted <br />to fulfill the requirements of Rules 2.08.3, 2.06.2, 2.06.3, 2.06.5, 2.06.7, <br />and 3.02.2(4). <br />Rule 2.08.3 requires that the Division conduct a review of each permit issued, <br />prior to its Mid-term (2-1/2 years). Based on this review, for good cause <br />shown, the Division may require reasonable revisions or modifications of the <br />permit provisions to ensure compliance with the Act and Regulations. <br />Rules 2.06.2, 2.06.3, 2.06.5, and 2.06.7 require that experimental practices, <br />mountain top removal variances, variances from approximate original contour <br />(AOC), and variances from contemporaneous reclamation, respectively, be <br />reviewed by the Division where applicable during the Mid-term review. <br />Rule 3.02.2(4) requires that the Division review the amount of the bond and <br />the terms of acceptance of the bond every 2-1/2 years. <br />The Mid-term Review of the Foidel Creek Mine consisted of a review of the <br />findings document, the permit application and subsequent revisions, <br />stipulations, field reports,and annual reports. Also a cursory review of the <br />Bond was conducted. <br />The document is organized as follows: Section I contains a brief history of <br />the mine. Section II contains a summary of permit actions. Section III is a <br />review of the stipulations attached to the permit. Section IV is a summary of <br />the review and a discussion of any problems identified in this review or <br />otherwise, which will need to be resolved. Section V is a review of the Bond. <br />Section I - History <br />The Foidel Creek Mine was originally proposed as a pilot project to determine <br />economic and technical feasibility of an underground coal mine utilizing an <br />unreclaimed pit of the Energy Mine No. 1 as a portal face up. The Division <br />approved the mine in May of 1983 via a Permit Revision to the adjacent <br />Surface Mine under permit C-79-177. The mine was subsequently separated from <br />the surface operation and assigned Permit No. C-82-056 to be permitted as the <br />Foidel Creek Mine under TCC. This permit was revised to expand the permit <br />area in 1986. The permit was then renewed in May of 1988. The current proper <br />permit expiration date is May 18, 1993. <br />Since the permit was renewed the mine has been operating smoothly with mining <br />generally progressing as planned. Two revisions of note which significantly <br />changed the face of the the operations were TR 8 and TR 12. Technical <br />Revision 8 was for the addition of an overland conveyor from the Foidel Creek <br />Tipple to the rail loadout. Technical Revision 12 was initiated to transfer a <br />significant portion of the Surface facilities from Colorado Yampa Coal <br />Company's Mine 1, 2 and Eckman Park over to TCC. <br />There has been one violation issued since the last renewal. This was NOV <br />C-92-003 which was issued on January 27, 1992 for failure to maintain the Coal <br />Waste Pile. Resolution of the violation is still outstanding. <br />-1- <br />
