PHELPS <br />COUNTY ATTORNEY <br />Please be advised that the Pueblo County Planning Commission, at its <br />regular meeting held on January 24, 1984, voted to a rove Special <br />Use Permit No. 281 with the following conditions: <br />I) Fountain Sand and Gravel Company be responsible <br />for fugitive dust emissions control on the unpaved <br />haul road and the unpaved portion of Stockyard's Road. <br />2) Staff research and report to the County Planning <br />Commission as to the ownership of Stockyard's Road <br />and recommend conditions, if any, to mitigate <br />additional heavy truck traffic loading to public <br />rights-of-way. <br />3) To insure that no additional erosion is to be caused <br />to adjacent properties, mining shall not occur within <br />50 feet of property lines. <br />4) One-year review. <br />A copy of this action will be sent to the Pueblo Regional Planning <br />Commission and a copy retained in this office for future reference. <br />If you should have any questions, please do not hesitate to contact <br />this office at 543-3550, ext. 281. <br />ely, / <br />.
