Johnston <br />From: Western Colorado Supervisor, U.S. Fish and Wildlife Service, Ecological Services, <br />-_ _ _ _ _ Grand Junction, Colorado ~ ~~ - - - -- -- - <br />C~ii~:~. ~ ~t <br />Subject: Water Depletion Payment Clarification f Bowie 1 and 2 Mining Operations. <br />The Fish and Wildlife Service (Service) is contacting the Office of Surface Mining, Reclamation, and <br />Enforcement (OSM) concerning our September 24, 20041etter and the non-receipt of depletion <br />payments for both the Bowie 1 and 2 mining operations. Please refer to that letter for the discussion <br />below. <br />Review of Service records clarified all but two missing payments for Bowie 1 and 2. The depletions <br />for 42.6 acre-feet (Bowie 1) and 113 acre-feet (Bowie #2) did not reflect payments. In a letter dated <br />February 10, 2005, the operator of the two mines, J.E. Stover & Associates (Stover) provided three <br />documents showing a payment of $2,234.42, the amount needed to cover the two depletions. The <br />documentation included the following: <br />1. Copy of Stover's hand written check register indicating check number 2520 was made out to <br />the National Fish and Wildlife Foundation in the amount of $2,234.42 and dated December <br />20, 1999. <br />2. Copy of check 2520 filled out from Stover's check book. (Parts of the check are not legible.) <br />3. Stover bank statement indicating check 2520 for $2,234.42 cleared. <br />-- WeTequest OSM-to-contact-the project proponents notifying them'that t hzServiceaccepts the -- - <br />documents as proof of payment closing the subject matter and that we appreciate their cooperation. <br />We thank you for your attention to this matter.
