Box 14158 <br />2760-R South Havana Street <br />Aurora, Colorado 80014-2618 <br />Re: Fruits Mines (Files 79-60 VG/C, C-81-015, C-83-061, C-84-066, and <br />C-84-064) <br />Dear Mr. Fernette: <br />Thank you for taking time to meet with Tom Gills, Mike Savage and me on <br />Apr11 4, 1988, to discuss American Shield's conceptual plans for the Fruits <br />properties. As stated in the meeting, the Division will assist American <br />Shield to the extent possible in providing guidance with regard to permitting, <br />issues and requirements for the property. i <br />The Division would like to resolve two outstanding issues surrounding these <br />properties and applications within the next three months. First, the Divisior <br />requests that American Shield indicate-to the Division whether American Shielc <br />intends to pursue the permitting of the currently filed applications for the <br />Central Lease C-83-061, the Northern Lease C-84-066, and Eastern Lease <br />C-84-064. Given the amount of time these applications have been pending <br />without response to the Division's permitting questions, the Division will <br />need to take an action. The only viable Division action given the lack of a <br />specific mine plan would be to deny the permit applications unless American <br />Shield elects to withdraw said applications. Such a withdrawal would not in <br />any way affect future permitting actions. Second, American Shield needs to <br />present the Division with plans for the existing Fruits No. 1 and 2 <br />disturbance.
