<br /> <br />Jay ?ones <br />March 4, 1994 <br />P,.ge 2 <br /> <br />A definitive understanding of legislative intent is hard to achieve in Colorado since <br />committees of the General Assembly do not publish committee reports. Nor is there a <br />verbatim transcript of colloquy during floor debate which sometimes is used to divine <br />Congressional intent on federal legislative matters. Nevertheless, I find it somewhat <br />persuasive that the Mined Land Reclamation Board has failed to address subsidence in its <br />rules over that last seventeen years. Surely it would have done so had it felt that <br />subsidence was within the regulatory mandate of the statute. <br />Although you did not request a legal opinion and this letter does not purport to be a legal <br />opinion, it does reflect my best recollection of the General Assembly's actions. <br />Please ]et me know if I can provide you with additional information. <br />DWD/jb <br />Ver~1y yours/ <br />David W.
