Future disposal might also occur within a large coal processing <br />waste disposal site which would be constructed in conjunction with a proposed coal <br />processing facility within the Munger Central Facilities Complex, which has not yet <br />been constructed. <br />Certain required information relating to surface disposal of coal mine waste and return <br />of coal mine waste to underground workings has not been included in the application, <br />and the following stipulation is necessary. <br />STIPULATION NO. 28 <br />WITHIN SIX MONTHS OF PERMIT ISSUANCE AND PRIOR TO ANY <br />SURFACE DISPOSAL OF COAL MINE WASTE, THE PERMITTEE WILL <br />IDENTIFY THE SOURCE OF AN APPROPRIATE VOLUME OF SUITABLE <br />NON-TOXIC, NON-COMBUSTIBLE COVER MATERIAL TO BE PLACED <br />OVER THE GRADED REFUSE PRIOR TO TOPSOILING, PURSUANT TO <br />RULE 4.10.4(5). UNLESS ANALYSES ARE PROVIDED WHICH <br />DEMONSTRATE A LESSER COVER THICKNESS WILL ALLOW FOR <br />SUCCESSFUL RECLAMATION, THE PLAN WILL SPECIFY THAT A <br />MINIMUM COVER THICKNESS OF FOUR FEET WILL BE PLACED ON THE <br />GRADED REFUSE. <br />ALSO WITHIN SIX MONTHS OF PERMIT ISSUANCE, A DETAILED <br />DESCRIPTION OF ANY PROPOSED COAL MINE WASTE DISPOSAL <br />WITHIN ABANDONED WORKINGS SHALL BE PROVIDED, PURSUANT TO <br />RULE 2.05.3(9)(a) AND (b). DOCUMENTATION OF MINE SAFETY AND <br />HEALTH ADMINISTRATION APPROVAL OF DISPOSAL WITHIN <br />UNDERGROUND WORKINGS WILL NEED TO BE PROVIDED, PURSUANT <br />TO RULE 4.11.3. <br />The McClane permit application does not specifically address the storage and final <br />disposal of noncoal wastes such as waste lubricants, flammable liquids, garbage, <br />abandoned machinery, waste lumber, and other combustibles. The following stipulation <br />is required. <br />STIPULATION NO. 29 <br />WITHIN THIRTY DAYS OF PERMIT ISSUANCE, THE OPERATOR WILL <br />SUBMIT A PLAN FOR TEMPORARY STORAGE AND FINAL DISPOSAL OF <br />NONCOAL WASTES PURSUANT TO RULES 4.11.4(1),(2), AND (3). <br />24 <br />
