Lochhead E*ecwive D~reuor Michael B Lo~q Diriswn Director The Division wishes to take this opportunity to summarize the progress in resolving the outstanding issues from the coal refuse pile Special Focus Inspection of the Bowie No. 1 Mine, which was conducted on August 19, 1997. Bowie Resources Limited (BRL) is the petmittee of the mine. At that inspection, Ron Sassaman and Glen Golden represented the Office of Surface Mining (OSM). The following is a list of the outstanding issues, and the. current status of their resolution. These issues were taken from the OSM Mine-Site Evaluation Inspection Report, dated September 15, 1997, as well as from the Division of Minerals and Geology (DMG) Coal Inspection Report, issued August 28, 1997. There was a question as to whether or not the SEDCAD ditch designs in the permit application included freeboard. The SEDCAD designs were examined by DMG and it was determined that the ditch dimensions listed in the permit application include the required freeboard. DMG believes that this issue has been resolved. 2. OSM stated that clarification was needed as to whether or not a toe bench. measuring at least 10 feet by 45 feet, was required at the toe of the waste pile of the east addition of the West Ridge waste pile, in the vicinity of the underdrain. During the special focus inspection, the toe bench had not been observed.
