The Division mailed a letter to you dated <br />October 5, 1993, in which the Division requested verification of property ownership boundaries and <br />comments concerning the proposed stream channel realignment, We appreciate your cooperative <br />response received by phone on October 25, 1993 and by letter received November 10, 1993. The <br />purpose of this second letter is to describe the reclamation activities that the Division proposes to <br />conduct on your land. If the Division does not receive a response to this Letter by Febtvary 13, <br />1994, the Division will assume your consent and proceed with the plans described herein. <br />Enclosed are three maps titled Map I, Map II, and Map III. Map I shows the area within the <br />mining perrttit area that is owned by you and by Darrell and Pollye Nance. Map I also shows the <br />areas covered by Maps II and II, and the mine haul road that you have indicated you wish to <br />remain. Maps II and III highlight the locations of reclamation activities proposed by the Division <br />that may affect property owned by you. The circled red numbers on Maps II and III correspond to <br />the numbered items of this letter. The reclamation items listed in this letter have been characterized <br />as possessing high, medium, or low priority based upon the Division's determination of potential <br />environmental degradation and threat to public safety. The Division has prioritized the reclamation <br />items in the event that sufficient bond is not available to complete reclamation of all items listed for <br />the entire mine area. <br />Proposed Reclamation Plan (Numbered items correspond to Map fI) <br />1. The approved mine operations plan in the now-revoked mining permit had allowed streamflow <br />from the canyon located on the south side of Del Agua Creek to be diverted to pond LS-1?2, as <br />shown on Map II, Following revocation of the permit in April 1993, TBM ceased maintenance <br />of the drainage control structures that conveyed this streamflow to pond 15-P2.
