Also Illustration 22 has been revised appropriately. <br />Two copies of Maps 43, 44 and 46 and two copies of revised Illustra- <br />tion 22 are enclosed in compliance with Stipulation 13. <br />Stipulation 14 <br />Western Fuels has revised the plans for Sediment Pond DP-1 to show <br />1.2 feet of freeboard between the principal and emergency spillways <br />with a 36" diameter spillway riser. Map 34, Revision C shows these <br />changes. Also, page 10 of 12, Illustration 7 has been changed <br />appropriately. Two copies of Map 34, Revision C and two copies of <br />page 10 of Illustration 7 are enclosed to comply with this stipula- <br />tion. <br />Stipulation 28 <br />Western Fuels hereby commits to not using persistent pesticides <br />unless approved by the regulatory authority. Further, Western <br />Fuels will fence ponds that are determined to contain toxic materials. <br />This commitment was required 30 days after approval of the permit, <br />but by oversight was not included with our submittal of August <br />25, 1981. Our intent is to comply with all the stipulations. <br />I hope these responses adequately meet the stipulations that we <br />had to respond to within 90 days of permit approval.
