The revision is ret~uested to modify <br />the postmine topography in the 5-W Pit (Mining Area <br />No. 1). Peabody does not intend to mine any more <br />coal in the 5-W Pit due to high ratios for a <br />scraper operation. If and when additional orders <br />are obtained for Nucla coal, it will be mined from <br />the Nucla East area. <br />The precise timing of the final reclamation of the <br />5-W Pit has yet to be determined. It will be <br />based, in part, on negotiations with the Ruling <br />Board of Colorado Ute. As currently anticipated, <br />however, this reclamation will be initiated by <br />about October 1, 1991. Peabody understands that <br />notice must be given to the Division prior to <br />beginning this operation and that the permit will <br />be activated for this activity. <br />Since the 5-W Pit did not extend as far to the <br />north as permitted, the volume of spoil available <br />for backfilling has changed, necessitating a change <br />in the postmining topography. As stated on Page <br />22-1 (Volume 14, Tab 22) of the Nucla PAP, the 5-W <br />Pit area (S1/2, SW1/4, Section 25) has the <br />potential for being irrigated due _•tq water <br />availability from irrigation ditches to the <br />immediate north of the pit. While Peabody will not <br />irrigate this area, the revised postmine topography <br />has been designed to maintain the potential for <br />irrigation should a postmine land owner so desire. <br />The planned postmine revegetation of the area does <br />not change. Therefore, as previously discussed <br />with Carl Mount, no change to Exhibit 22-1 has been <br />made. <br />
