The revision is ret~uested to modify the postmine topography in the 5-W Pit (Mining Area No. 1). Peabody does not intend to mine any more coal in the 5-W Pit due to high ratios for a scraper operation. If and when additional orders are obtained for Nucla coal, it will be mined from the Nucla East area. The precise timing of the final reclamation of the 5-W Pit has yet to be determined. It will be based, in part, on negotiations with the Ruling Board of Colorado Ute. As currently anticipated, however, this reclamation will be initiated by about October 1, 1991. Peabody understands that notice must be given to the Division prior to beginning this operation and that the permit will be activated for this activity. Since the 5-W Pit did not extend as far to the north as permitted, the volume of spoil available for backfilling has changed, necessitating a change in the postmining topography. As stated on Page 22-1 (Volume 14, Tab 22) of the Nucla PAP, the 5-W Pit area (S1/2, SW1/4, Section 25) has the potential for being irrigated due _•tq water availability from irrigation ditches to the immediate north of the pit. While Peabody will not irrigate this area, the revised postmine topography has been designed to maintain the potential for irrigation should a postmine land owner so desire. The planned postmine revegetation of the area does not change. Therefore, as previously discussed with Carl Mount, no change to Exhibit 22-1 has been made.
