necessarily and normally associated with the drilling, and initial n <br /> completion, of each of the above described welloe Normal damages <br /> include construction of one access road gems preparation and <br /> use of the drillsite area, preparation and use of reserve pits, and <br /> construction, installation of production equipment and facilities <br /> such as flowlines, separators and tank batte �necessary for the <br /> c.d. <br /> production of oil and/or gas from the said well. Said sum of <br /> ;1-1, 600 . 00 also includes payment to Owner for its earth moving and <br /> drillpad buildup activities related to the proposed drillsite for <br /> such well, to a condition adequate, as mutually agreed to, which <br /> would allow Snyder to drill its well on a firm and stable <br /> "drillpad" , so as not to endanger the crews or risk damage to the <br /> drilling rig and/or completion equipment. Said sum of $12 , 500. 00 <br /> is accepted by Owner as full settlement and satisfaction of all <br /> detriment, injuries and damages growing out of, incident to, or in <br /> connection with the drilling and initial completion of said wellgl <br /> C'v, <br /> or caused by the moving in and the moving out of Snyder's derrick, <br /> drilling tools, vehicles, and all other machinery and equipment <br /> necessary or incident to the drilling, testing, completion and / <br /> operation of said wellJ�'� <br /> 2 . Snyder recognizes the close proximity of its proposed <br /> drillsite to the Owner's permanent access road related to its <br /> mining activities. In this regard, the parties hereto agree to <br /> allow access to each other concerning the usage of said roadway <br /> throughout the drilling/completion and operations of the above <br /> described well. In the event there is a need to temporarily block <br /> access of said roadway by either party, it is agreed that a three <br /> (3) business day notice will be given to the respective party, <br /> stating the reason for said blockage and the expected blockage <br /> dates. If a reasonable compromise concerning such blockage cannot <br /> be negotiated, the parties shall mutually agree to alternate access <br /> route or plan of action. <br /> 3 . When constructing the wellsite location$ the topsoil <br /> shall be removed from the area over the pits, stock piled and held <br /> in reserve until the contour of the site is re-established, at <br /> which time it will be replaced evenly over the wellsite area. In <br /> the alternative, if agreed to by both parties hereto, the pit area <br /> shall be sufficiently bermed and surrounding the pit area to allow <br /> sufficient usage as said "reserve pit" . If utilizing this berm <br /> type arrangement, Snyder agrees to use its best efforts not to <br /> allow any spillage or leak from said reserve pit into the lake area <br /> directly to the south of said drillsite and located on lands under <br /> mining lease to Owner. The wellsites shall be ripped and returned, <br /> as best as practicable, to the original slope and contour, as <br /> existed immedi�tely prior to drilling and completion activities. <br /> rJ (/1✓ <br /> Such wellsite$ and reserve pits shall be cleared of drilling mud �- <br /> and oil following completion operations. <br /> 2 <br />
