Proposed Decision <br />The Colorado Division of Minerals and Geology proposes to APPROVE an application for <br />renewal of a valid existing permit. The application was submitted by Hayden Gulch Coal <br />Company for the mine. This decision is based on a finding that the operations will comply with <br />all requirements of the Colorado State Program as found in the Colorado Surface Coal Mining <br />Reclamation Act, C.R.S. 34-33-101 et seq., and the Regulations promulgated pursuant to the Act. <br />If no request for a formal hearing is made within thirty (30) days of the first publication of the <br />issuance of this proposed decision, then this decision becomes final. Upon submittal of <br />acceptable surety by the applicant, the permit will be issued. The permit application, all <br />supporting documentation and any stipulations or conditions will become a binding part of the <br />permit. <br />The Summary of Review, dated 3 December 1992, for the second permit renewal stated that all <br />six stipulations attached to the permit application had been resolved. Only one stipulation was <br />added to this permit application since the permit renewal of 1992. On 18 August 1995, through <br />Minor Revision No. 9, Stipulation No. 7 was added. The stipulation reads "The approval of <br />Minor Revision No. 9 for the HG Mine is conditioned upon resolution of West Virginia audit <br />violation no. 930121130. Proof of resolution of this issue must be submitted to the Division, as <br />soon as it becomes available." On 10 January 1997, the Division conducted an Applicant <br />Violator System (AVS) check for the Hayden Gulch Mine Permit Renewal No. 3. The West <br />Virginia audit violation was no longer on AVS. Therefore, the Division terminated Stipulation <br />No. 7. <br />2 <br />
