A copy of the commitment by AGUA will be <br />forwarded under separate cover..AGUA currently has an approved Arkansas River Replacement <br />Plan and has excess replacement water available which can be used for the replacements of this <br />plan. Because use of water (or mining is temporary, Beltramo propcses an annual renewal of this <br />plan using leased water From AGUA until such time as mining is complete. At that time the site will <br />be backfilled to eliminate any exposed water surface. A bond (DMG Bond tdo. 5999645) in the <br />amount of $75,000 will provide (or reclamation of the site and back-nlling o° [he pit in the event <br />the requirement of the reclamation permit are not completed. Purchase of water rights for <br />augmentation of this proposed temporary use's no: necessary. <br />AGUA annually obtains water for its Arkansas Rivcr Rcplaccment Plan from the Board of Vs'ater <br />Works of Pueblo, Colorado Springs Utilities, the Southeastern Colorado water Conservancy <br />District, and from its ownership and lease of shares of Excelsior Ditch stock. Replacements for <br />depletions caused by Beltramo's gravel mining will be included earl, month with the replacements <br />AGUA provides for other substitute water supply plans it adrninisters, according to the schedule in <br />Table 3.
