Shelton <br />Director <br />November 24, 1981 <br />TO: Mike Savage <br />FROM: Jerry Zimpfer~y_ <br />RE: Kerr Coal Company - Response to Stipulation Concerning Stream <br />Depletion in Sudduth Draw <br />The operator has provided the Division with a during-operations assessment <br />of stream depletion and has proposed pumping water from the mine pit <br />a.s a possible mitigation. The analysis needs to be reviewed in more <br />detail by Roy Cox. <br />However, several factors seem not to have been taken into account by the <br />operator. First, there is a 2,000 foot yap between the point of withdrawal <br />and the point of discharge. Tic significance of this gap has not been <br />assessed. Secondly, tl~e water quality would likely be degraded by exposure <br />to fine material in the pit. hlost importantly, the operator has failed <br />to consider the post-mining situation. After backfilling and grading, <br />what would be the expected water loss from Sudduth Draw?' Is this a temporal <br />or a permanent effect?
