The Division is proposing full approval with stipulations for the <br />Eagle Mine No. 5 mine. The partial approval limits the conduct of <br />surface coal mining anU reclamation operations for the Eagle IJo. 9 mine <br />to environmental inonitoriny and maintenance of existing surface <br />facilities, including the sedimentation ponds and mine dewateriny ponds. <br />No new surface disturoances are recommended for approval within this <br />findings document. N detailed discussion is provided within this <br />document. <br />This partial approval decision is based on a finding that the operations <br />recommended for approval will comply with all requirements of the <br />Colorado Surface Coal Mining Reclamation Act, C.R.S. 1973, 34-33-1U1 et <br />seg., and the regulations promulgated thereunder. Findings of compliance <br />for the Eagle No. 9 mine cannot be made in the sections of this document <br />addressing the Probaole Hydrologic Consequences, Alluvial Valley Floors, <br />and Subsidence. For these reasons the Division is not approving any <br />additional mining in the Eagle No. 9 mine at this time. Review of the <br />Eagle No. 9 mine will continue under the procedures prescribed in the <br />Colorado Surface Coal Mining Reclamation Act. <br />The permit application and the stipulations will became a binding part of <br />the pennit upon approval. All responses to stipulations must be prepared <br />in a manner so as to be inserted into the per~oic application. The <br />stipulations for the Eagle fJo. 5 and rJo. 9 mines are as follows: <br />1.
