Mr. Michael Ossola 2 December 3, 1992
other trees appeared healthy. The two large trees downdraft of the fan did appear to be a
little off color but not any more than some other trees in the general vicinity.
Second, according to Joe Nugent of the Colorado Mine Safety and Training Program,
methane does not harm vegetation, and, being lighter than air, would rise, not settle into a
valley. However, he added that other compounds in the exhaust could damage vegetation.
According to Cathy Rhodes and Arch Crouse of the Air Pollution Control Division of the
Colorado Department of Health, an air pollution emissions notice IAPEN) would list all
compounds in the exhaust. An APEN is now required, rather than an emissions permit.
The Compliance Monitoring and Enforcement Section of the Air Pollution Control Division,
Colorado Department of Health has jurisdiction over this matter and has been informed of
the situation. Should you have further concerns regarding air quality, please contact them.
Third, local governments have jurisdiction over potential noise pollution problems, rather
than the State.
Rule 5.02.515) states that an informal review of the Division's decision to not take
enforcement action can be requested in writing by the person who requested the
inspection. Our Administrator would conduct the informal review. This informal review
will not affect any right to a formal review under 34-33-124 of the Colorado Surface Coal
Mining Reclamation Act or to a citizen's suit under 34-33-135 of the same Act.
If you have any questions, please call me.
Sincerely,
.
