I. Underground development waste from underground workings at the West <br /> Elk Mine is handled as coal mine waste and placed on the Refuse Pile <br /> Expansion area or the Lower Refuse Pile. No acid-forming or toxic-forming <br /> materials are present in the spoil in quantities significant enough to affect <br /> groundwater quality. Therefore, special handling is not required for these <br /> materials (4.05.8(3)). <br /> F. Impoundments <br /> 1. Refer to the section regarding sediment ponds (4.05.9). <br /> G. Surface and Groundwater Monitoring <br /> 1. The applicant will conduct monitoring of groundwater in a manner approved <br /> by the Division. The groundwater monitoring plan is specified in Section <br /> 2.05.4, Groundwater Monitoring, and shown on Table 5, contained in <br /> Volume 1 of the permit document (4.05.13(I)). <br /> 2. The applicant will conduct monitoring of surface water in a manner <br /> approved by the Division. The monitoring plan is specified in <br /> Section 2.05.4, Surface Water Monitoring, and shown on Table 5 contained <br /> in Volume 1 of the permit document (4.05.13(2)). <br /> H. Transfer of Wells <br /> 1. No transfer of wells is proposed at this time. All monitoring wells will be <br /> reclaimed prior to bond release (4.05.14 (3)). <br /> I. Discharge of Water into an Underground Mine <br /> 1. There will not be any discharge of water into an underground mine <br /> (4.05.16(2)). <br /> J. Stream Buffer Zones <br /> 1. The Division proposes to approve underground mining activities within <br /> 100 feet of the North Fork of the Gunnison River, which is a perennial <br /> stream with a biological community. This decision is based on a finding that <br /> the original stream channel will not be disturbed, water quality and quantity <br /> shall not be adversely affected, and appropriate riparian vegetation will be <br /> reestablished. The buffer zone variance is granted for the water intake <br /> gallery, sediment pond and associated spillways and ditches, a railroad <br /> siding, the railroad loadout facility, a light-use road and a portion of the old <br /> Bear No. 1 and 2 Mines site. These facilities are located on the north and <br /> south banks of the North Fork of the Gunnison River. Figure 18 in the <br /> 27 <br />
