Shelton <br />Director <br />January 12, 1981 <br />PROPOSED DECISION <br />Kerr Coal Company <br />Marr Strip, Marr Prep Plant <br />The Colorado Division of Alined Land Reclamation proposes to approve with stipu- <br />lations an application for a permit to conduct coal mining submitted by Kerr <br />Coal Company for the Marr Strip and Marr Prep Plant. <br />This approval decision is based on a finding that the proposed operation will <br />comply with all requirements of the Colorado Surface Coal Mining Reclamation <br />Act, C.R.S. I973 34-33-I01 et.seq., and the Rules promulgated thereunder. <br />The finding of compliance, and the stipulations which are a part of this <br />approval, are attached to this document. <br />The permit cannot issue until alt statutory notice and public comment require- <br />ments have been satisfied, and until bond for the first bonding increment, <br />which has been set at 54,290,800.OQ.has been posted. The Tipple area will <br />continue to be bonded separately at the present level, which is 533,000.00. <br />The tipple area coill continue to be bonded separately at the present level, <br />which is $33,000.00. <br />r <br />
