Begej: <br />As we discussed, trial has been scheduled in this case to <br />begin Monday, February 2, 1993 in the District Court of Pueblo <br />County before the Honorable Richard D. Robb. It is scheduled to <br />last four weeks. <br />You may be called to testify as a witness on behalf of <br />the Defendant, Colorado National Hank-Pueblo. This will confirm <br />your meeting with David Stark and Ken Skogq on Tuesday, January 12, <br />1993 at 9:00 a.m. in our office to discuss your testimony. You may <br />testify regarding the portions oP the Southfield Mine permit <br />pertaining to the design, construction and maintenance of the waste <br />pile on the premises and the respective responsibilities of parties <br />or entities involved in the mining of the premises with respect to <br />the waste pile. You may also testify regarding the bond posted by <br />Energy Fuels to assure performance by Energy Fuels of its <br />responsibilities with respect to the waste pile. You may also <br />testify about the regulations governing the design, construction <br />and maintenance of the waste pile at the Southfield Mine and <br />specifically how the same negates the Plaintiffs alleged damage <br />claim related to the removal of the waste pile. <br />Enclosed are two outlines of the case.
