I.5 notification that a portion of the Dahlia North <br />Resources Pit DMG Case # M-94-093 has been transferred to Patrick Broda to fill with inert <br />debris in accordance with an inert fill licenses from the City of Commerce City. The Inert Fill <br />license includes reclamation measures that comply with similaz regulations found in section 3.1 <br />of the Division of Mining and Geology (DMG} regulations for the Extraction of Construction <br />Materials. <br />On May 13, 2003 the Broda Inert Fill property received an inert fill permit from Commerce City <br />with a recommendation of approval from the Colorado Department of Public Health and <br />Environment (CDPHE). A copy of the permit license and regulatory correspondence is attached. <br />The inert fill permit includes a revegitation plan very similaz to the one provided in the DMG <br />permit and is assured with a Financial Assurance plan completed under the regulation pertaining <br />to Solid Waste Disposal Sites and Facilities (6 CCR 1007-2). <br />DMG regulations in 3.1.5 (1-8) are generally covered in the Broda's Inert Fill Application dated <br />8/12/02 and the Revision #1 of the Broda's Inert Fill Application dated 10/22/02.
