Dept. of Natural Resc_~rces SUBJECT: Hayden Gulch Project Technical Revision Request, Permit # 77-99 Our File AF 1-300-14 The purpose of this letter is to advise you of the formation of the H-G Coal Company, a general partnership owned jointly and equally by wholly owned subsidiaries of W.R. Grace & Co. of New York and Hanna i4ining Company of Cleveland, Ohio, and to request a technical revision trans- ferring authority and responsibility of the Hayden Gulch mining reclamation plans and performance bond from W.R. Grace & Co. to the new H-G Coal Company. There will be no change in the mining and reclamation plans already approved by the Mined Land Reclamation Board on October 27, 1977, with an effective date to commence operations approved by the Attorney General's Office on January 20, 1978. All assets, permits, agreements, contract, and commitments, including sales contracts for the coal and the mining contract with Morrison-Knudsen Contractors of Boise, Idaho, have been transferred in toto to H-G Coal Company subject to approval by appropriate governmental agencies. It will be H-G's obligation to conduct operations in accord with said agreements with the full backing of the partners, W.R. Grace & Co, and the Hanna Mining Company.
