Mills <br />Colorado Mined Land Reclamation Board <br />1313 Sherman Street <br />Denver, Colorado 80203 <br />Dear Mr. Mills: <br />Reference: Letter to John Eilts <br />Ditch paralleling railroad tracks - Within the D & RGW <br />railroad right-of-way there was at one time a slight <br />depression which was filled with trees and brush. There <br />appeared to be no active maintenance of this depression in a <br />manner to transmit water, although at times water did stand <br />within the depression. When Sun Coal constructed the <br />access along the railroad siding within the railroad right- <br />of-way, part of this depression was filled. If 1Sr. Eilts <br />desired to construct a ditch to carry water through this <br />area, Sun Coal will not oppose his efforts to do so, pro- <br />vided they do not interfere with the operation of Sun Coal <br />facilities. <br />Gravel bars located near substation - Sun Coal has been <br />unable to locate these alledged gravel bars within the <br />permit boundary. Any gravel bars lying outside the permit <br />boundary that may be alluded to in your letter, are either <br />because of work done by someone else and, therefore, not Sun <br />Coal's responsibility. There is really no available topsoil <br />in the area of the Sun Coal tipple and substation, and never <br />has been as the area is a large gravel bar. <br />Increasing access road width - Sun Coal intends to keep a <br />safe access road to it's mine activities.
