less than one (1) squaze mile. The Division finds that the fords will not
affect stream sedimentation or fish, wildlife, and related values due to
light and infrequent use.
3. All but one of the current light-use roads aze pre-existing roads and will be
retained after reclamation of the Bowie No. 2 Mine site. There is one
temporary access road that was constructed to access the west side of the
loadout trackage for installation of a main line switch. Stipulation No. 13,
attached to the proposed decision for Permit Revision No. 6, required the
submittal of the CDOT road use permit for this road. The temporary light
use road will be reclaimed. Two additional light use roads are proposed in
Permit Revision No. 7. Both would allow access to two new material
storage areas.
II. Support Facilities -Rule 4.04
A. Construction of support facilities will not result in change, destruction or
disruption of oil, gas pipelines or water wells, nor will coal slurry pipelines or
railroads be impacted. Therefore, the Division approved those activities (4.04(6)).
A list of approved facilities may be found in Section 2.05.3(3) of the permit.
III. Hydrologic Balance -Rule 4.05
A. Water Quality Standazds and Effluent Limitations
The Division granted approval for small azea exemptions from the use of
sediment ponds, due to the limited size of the azeas and due to the fact that
ponds and treatment facilities aze not necessary for the drainage to meet
the effluent limitations of Rule 4.05.2 and applicable State and Federal
water quality standazds for receiving streams, and also due to [he fact that
no mixing of surface drainage with a discharge form underground
workings will occur. The locations of the small azeas to be exempted are
discussed on Page 2.05-32 of the permit application and are shown on
permit document Map 21-1 and Map 95266-02 (4.05.2(3)(b)(i)).
Storm runoff from sixteen small azeas at the mine site aze subjected to
alternate treatment prior to leaving the permit azea. The sixteen areas are
1.) the "material storage azea below Pond C, 2.) the pump station, 3.) the
topsoil stockpile neaz the Gob pile, 4.) the coverfill stockpile and coverfill
topsoil stockpile neaz the Gob pile, 5.) the azea azound the mine engineer's
building, 6.) the Freeman Gulch vent fan site, 7) the azea underneath the
conveyor, between old State Highway 133 and the Fire mountain Canal
and 8) nine small azeas along the train loadout railroad track outslopes. In
addition, alternate sediment control measures are employed at several
methane de-gas drill pads.
27
