concerns of the USDA-FS in the adequacy review response letter dated July 22, 2003. In a reply <br />letter dated September 24, 2003, the USDA-FS concurred with the approval of PR-08, provided <br />that a commitment was added concerning visual subsidence monitoring in the Sheep Corral <br />drainage. In a final submittal dated September 24, 2003, BRL added the commitment to the <br />permit text. <br />The application for Permit Revision No. 9, dated June 1, 2005, was received at the Division on <br />June 3, 2005. The submittal was called complete on June 13, 2005. Completeness letters were <br />sent on June 13, 2005 and the completeness public notice was published. Only one letter, from <br />the Office of the State Engineer, Division of Water Resources, was received at the Division <br />concerning Permit Revision No. 9. They had no concerns. <br />The Division conducted an Applicant Violator System (AVS) check on August 31, 2005 and <br />October 4, 2005. The system and Office of Surface Mining recommendations were issue. <br />The Division sent its preliminary adequacy review letter on August 10, 2005. BRL submitted its <br />preliminary adequacy review responses in a submittal dated September 16, 2005. Additional <br />information was sent by BRL in a submittal dated September 20. The Bureau of Land <br />Management sent a copy of the modified lease COC-61209 on September 9, 2005. <br />The Division sent its final adequacy letter to BRL on September 28, 2005. BRL responded on <br />October 7, 2005. All outstanding issues were resolved. <br />Description of the Environment <br />With the approval of Permit Revision No. 9, the Bowie No. 2 coal mine permit azea will include <br />5,286 surface acres, of which 2,674 surface acres are federally owned and 2,612 acres are <br />privately owned. Private minerals within the permit azea encompass 1,957 acres with Federal <br />minerals accounting for the balance of 3,329 acres. The coal and the surface lands within the <br />present permit area are both federally and privately owned, as are the surface areas that have <br />been disturbed by surface developments. The total approved disturbed azea by surface operations <br />is 229.5 acres. <br />In the original permit application review, following discussions with the OSM in Denver and <br />based upon the specific recommendations of the OSM, it had been determined that the Bowie <br />No. 2 Mine would be considered a private mine for the purposes of permitting and inspection <br />regulation. However, the Bowie No. 2 Mine became a federal mine upon approval of Technical <br />Revision No. 16. Through that revision, BRL was granted permission to conduct mining in a <br />limited azea of the Iron Point Tract Federal Lease. <br />The Bowie No. 2 Mine is located in Delta County, approximately five (5) miles northeast of <br />Paonia, Colorado. The mine permit area is located on lands depicted on the U. S. Geological <br />Survey 7.5 minute Bowie Quadrangle Map, and the Bowie No. 2 mine portals are located <br />northwest of the Old King Mine portals (also known as the Bowie Mine).
