Time frames for public
review and comment on these pemtitting actions have expired, and as such, the Division does not require
that Wey continue to be available for public review at the courthouse, pursuant to the Colorado Surface
Coal Mining Reclamation Act (Article 33 of Title 34, as amended, (House Bill 1223/1979 Session Laws)
Colorado Revised Statutes).
DIVISION O F
MINERALS
GEOLOGY
RECLAMATION
MINING•SAFETY
Riu Owens
Governor
Greg E. However, it has been long-standing
Division policy that such materials are not required to be available for public review at the courthouse,
once all public review comment timefmmes pursuant to the application and proposed decision have
expired
My records indipte that there are currently no applications subject to public review timeframes for
Powderhom Coal Company, which would need to be on 51e at the courthouse, and our Division does not
object to the release of those materials requested by Ms. Hammond.
Please feel free to call me a[ (970) 242-5025, if you have any questions.
Sin
Dan ews
Environmental Protection Specialist
OF
Z' `~ III IIIIIIIIIIIII
999
ce: Tonya Hammond, PCC
Larry Routteq DMG Denver
