Time frames for public <br />review and comment on these pemtitting actions have expired, and as such, the Division does not require <br />that Wey continue to be available for public review at the courthouse, pursuant to the Colorado Surface <br />Coal Mining Reclamation Act (Article 33 of Title 34, as amended, (House Bill 1223/1979 Session Laws) <br />Colorado Revised Statutes). <br />DIVISION O F <br />MINERALS <br />GEOLOGY <br />RECLAMATION <br />MINING•SAFETY <br />Riu Owens <br />Governor <br />Greg E. Long <br />Division Director <br />The relevant section of the Act, 34-33-110(4), requires that application materials be filed with the county <br />clerk, or other public office, for public inspectioq subject to regulations issued by the Colorado Mined <br />Land Reclamation Board The Regulations of the Colorado Mined Land Reclamation Board for Coal <br />Mining reiterate the statutory requirement, and address public review timeframes associated with various <br />categories of application materials, as well as public comment periods pertinent to proposed decisions <br />issued by the Division. Neither the Ad nor the Regulations specify the time period for which application <br />materials are to be maintained az the public office, for public inspectioa Given This ambiguity, I appreciate <br />your potion with respect [o the application materials in question.
