Lons <br />D ivuion Di~ecbr <br />Thank you for your phone call on 6/26(96, regarding permitting issues at Bayfield Pit 1. <br />The purpose of this letter is to clarify the issues discussed. <br />Rule 1.10 describes the requirements for Amendments to existing Regular 112 permits. <br />Rule 1.4.1 describes the general provisions of the application review and consideration <br />process. Rule 1.4.5 states the specific requirements of applications for Regular 1 12 <br />Operations permits, and permit Amendments. <br />Regarding your question about the period of time required to complete the review <br />process, please see Rules 1.4.5131, 1.7.1 and 1.7.4. Pursuant to Rule 1.4.513-, DMG <br />cannot approve the Amendment application sooner than 30 days following the close of <br />the public comment period, providing public comments are submitted within the required <br />time period. The public comment period is described in Rule 1.7.4(2) as being 20 days of <br />the last day of publication. Rule 1.6.5(1) states that the operator shall publish the Public <br />Notice, described in Rule 1.6.2(1)(d1, once a week for four consecutive weeks. Rule <br />1.6.2(1)(d) states that the operator shall commence publication within 10 days of filing <br />the Amendment application with DMG. The earliest approval date allowed by the Rules <br />would be 20 days following the last date of publication, providing DMG does not receive <br />objections to the Amendment application within the 20 day period. <br />Regarding your question about notification of adjacent land owners, please see Rule <br />1.6.2(1)(e). Rule 1.6.2(11(e) requires that the operator mail, certified mail return receipt <br />requested, or personally serve a copy of the Notice described in Rule 1.6.211)(d), to all <br />mineral owners of the affected land and all surface owners within 200' of the boundary <br />of the affected land, within 10 davs of filing of the Amendment application with DMG. <br />Unfortunately, the Notices served previously during the County permitting process will <br />not satisfy the requirements of Rule 1.6.2(1)(e1. <br />Regarding your question about importing fill material for reclamation purposes, please see <br />
