P.01
. 1'1pR- 6-96 WED
,~

March 5, 1996
LARRY & ELAINE MAOTZ
1938 AWY 133
PAONIA, COLORADO 81428
Division of Minerals & Geology
Department of Natural Resources
$ David Berry
1313 Sherman St. Room 215
Denver, Co. 80203
Sent Via Fax: 303-832-8106
Dear David,
9F
Cam`
9~ ~`
o ~-
., ~ ~~-
~`
`996'
I called you to toady about the Mountain Coal Company, West Elk
Mina at Sommerset, Colorado, who mines coal under the property
that is owned by Larry & Elaine Mautz in the Lone Pine Canyon
area.
David, we discussed the concerns that were never resolved to
date, these problems are as follows.
1. The damage to the cabin up the Lone Pine area which was
damaged by the long wall being moved and the cabin moving and
causing damage to the structure. The attempt by West Elk Mine to
repair has now cracked and did not fix the problem. It appears
that it has still subsided more than the mining Company expected.
The repairs even have cracked.
2. The road that is up the Lone Pine area above the fan
site was repaired by the Mautz' not by the mine.
3. The Yefuse pile which was placed on our property, was
done with out our permission. This has now bees fenced by West
Elk.
These are just a few of the problems that Mountain Coal Company,
West Elk Hine, has not resolved with us. i do know that Wast Elk
Mine will take the line that they did not cause the damage or
that .the damage was taken care of, but I guess that I feel that
they, have sledded us one more time. We have not bean
unreasonable to west Elk Coal, but have asked them to treat us as
they would. like to be treated. This has not happened. We
receive letters back to us about how we want things that they
have not intent of pay for or fixing. If this is the way that
they treat one another then I guess that i doa!t want to be
involved with. them. They can play hard ball or just be fair and
do what is right and correct.
T :53
David, I am sorry to have to bring these problem before you
a sin, but I do feel that Mountain Coal Company, West Hlk Coal,
h~s not resolved these problems with us. If you can help, please
