Facilities removed included the water tank and the water line to the river as <br />well as all but two of the groundwater monitoring wells. Wells OW-15 at the <br />base of the sediment pond and OW-1 at the Lacy Loadout had not yet been <br />removed at the time of the inspection. The wells have to be reclaimed prior <br />to approval of a Phase I bond release application. <br />The topsoil stockpile at the eastern edge of the lower terrace has not been <br />completely distributed. This topsoil stockpile must be either distributed or re- <br />stockpiled and vegetated prior to the approval of a Phase I bond release <br />application. <br />The drainage channel which diverts runoff around the #1 Portal had been <br />constructed according to designs and appeared stable at the time of the <br />inspection. <br />In addition to the correction of the conditions noted above, tasks that remai^ <br />to be done at the site include removal of the sediment pond, concrete sputter <br />box, culvert C3, the irrigation line leading to the #1 Portal, backfdling of the <br />cut slope at the east end of the lower terrace, and completion of topsoil <br />redistribution. <br />IV. PROPOSED DECISION <br />Backfilling and regrading in accordance with the approved reclamation plan <br />has not been entirely accomplished at the Coal Ridge #1 Mine. Therefore, <br />the Division proposes to deny the Phase I bond release request. <br />The Division recommends submittal of a technical revision to more clearly <br />specify the requirements of the reclamation plan with regard to the tasks <br />noted above prior to the submittal of another bond release request. <br />Specifically, the technical revision should address: <br />• Stabilization of the terrace outslopes; <br />• Backfilling of the cut slope at the east end of the mine; <br />• Removal of culvert C3; and <br />• Disposal of waste rock. <br />Any person with a valid legal interest which might be adversely affected by <br />the proposed decision of the Division may request a formal hearing in <br />accordance with Rule 3.03.2(6). The written request must be received by the <br />Division within 30 days of the first publication of the proposed decision in the <br />3 <br />
