Box 1430 <br />Palisade, Colorado 81526 <br />Subject: Utility On Interstate 70 <br />Dear Larry: <br />The purpose of this letter is to clarify a few points raised in your letter of November 19, 1992. <br />A permit will be issued to Powderhorn Coal Company to place a 6 inch dischazge line in the <br />Interstate corridor as you have requested. The permit grants the right of occupancy within <br />the Interstate corridor, permanent Right of Way is not being granted. The permit is to <br />Powderhorn Coal Company not your Contractor. Powderhorn will be responsible for your <br />pipeline and your Contractor. Additional permits will be required to repair, replace or service <br />the line in the future. In addition, the original permit will make Powderhorn responsible for <br />any leakage and will require prompt repair. <br />The permit will be issued as soon as this office receives the Certificates of Insurance as stated <br />in our letter of October 13, 1992 and an Approved traffic control plan, which graphically <br />shows the project and the placement of Traffic Control signs. <br />The manhole must be flush to the ground for maintenance and for the safety of the traveling <br />public. <br />Please feel free to contact this office should you have any further questions. <br />Very truly yours, <br />by <br />xc: Moston/Perske <br />Abbott <br />Keller <br />File <br /> <br />DEC 2 81992 <br /> <br />Robert P.
