You indicated that <br />reclamation costs should include the cost to remove and/or grade <br />this material back into the mined area. We feel that this <br />material, including the stockpiled pit run, is valuable merchandise <br />as is and to waste this product by grading it back into the pit is <br />contrary to the stated mandate of the Mined Land Reclamation Act to <br />conserve natural resources. The volume of this material is <br />continuously changing as material is sold or transported for use at <br />other sites. Currently, there is approximately 3000 cubic yards of <br />material in this pit ranging from pit run to crushed and screened <br />rock. If required to bond for removal of this material, we would <br />bond to hire a broker at $0.50/yard to sell the material at current <br />market value of $4.05/yard for pit run. This will generate $12,150 <br />and after deducting reclamation costs of $983 and broker costs of <br />$1500, the state should owe Delta Sand and Gravel $9667. As <br />material is sold or new material is mined, it would be necessary to <br />constantly adjust the amount bonded for brokering this material. <br />However, we feel that because this is an income generating process, <br />it is not appropriate to bond for removal of this material. <br />I have answered the questions raised by your inspection to the <br />best of my ability and I believe that all our mines are in <br />compliance with the Mined Land Reclamation Act and the rules of the <br />Division of Minerals and Geology.
