U.S. Steel shall submit a study of noise levels, noise sources, and <br />methods that could be used to mitigate noise impacts at the proposed <br />Somerset ventilation fan along Hubbard Creek prior to the construction of <br />the facility. The study shall be conducted in consultation with the U.S, <br />Forest Service (USFS), OSM and the Division. U.S. Steel shall implement <br />noise abatement measures that are recommended is the study and in <br />consultation with the USFS, OSM and the Division vithin 90 days after the <br />completion of the fan facility. <br />2. Visual impacts associated with the construction of the Hubbard Creek <br />ventilation fan facility and future above-ground structures shall be <br />mitigated is the following manner: <br />a) All structures shall be colored, painted, covered or finished in a <br />natural color, whenever it will not violate any safety requirements <br />of any government or governmental agency. The purpose of the <br />painting is to blend with the color in the landscape character of the <br />vicinity. <br />b) Use indigenous plants to help screen the facility from passers-by. <br />These mitigative measures shall be completed vithin 90 days of the <br />construction of the ventilation fan facility. <br />REVISED STATE STIPULATIONS NOs. 1 and 2 <br />Stipulation No. 1 <br />THE SPECIES DIVERSITY OF THE SOMERSET MINE RECLAIMED AREAS SHALL ACHIEVE <br />AT LEASE THREE COOL SEASON PERENNIAL GRASSES AND ONE PERENNIAL FORE WITH <br />RELATIVE COVER EQUAL TO OR GREATER THAN THREE PERCENT OF THE TOTAL COVER. <br />THE COMBINED RELATIVE COVER OF THREE COOL SEASON PERENNIAL GRASSES AND <br />FORS SHOULD NOT ERCEED 80 PERCENT AND NO ONE SPECIES SHOULD COMPRISE <br />GREATER THAN 60 PERCENT OF THE TOTAL COVER. <br />Stipulation No. 2 <br />THE OPERATOR SHALL MEASURE WOODY PLANT DENSITY AND VEGETATION COVER ON THE <br />SOMERSET MINE RECLAIMED AREAS THE FIRST AND THIRD GROWING SEASONS <br />FOLLOWING RECLAMATION AT INTENSITIES EQU AL TO BASELINE SAMPLING LEVELS AND <br />SUBMIT THE RESULTS TO THE DIVISION WITHIN 60 DAYS AFTER THE DATA <br />COLLECTION. <br />--- <br />,` 1 <br />-.J <br />
