<br />The following described Federal lands are contained in the State's
<br />permit area, however, these lands are excluded is the Federal permlt
<br />area. Coal extraction and surface activities shall not be performed
<br />in these areas because the permittee does not have the legal right to
<br />enter.

<br />application of a 30° angle of dray to the permit area,
<br />Moreover, the permittee is authorized to conduct surface and
<br />reclamation operations connected with mining on the foregoing
<br />described property subject to the conditions of the leases, the
<br />approved mining plan, and Colorado State permit C-022-81, including
<br />all conditions, and all other applicable conditions, lays and
<br />regulations.
<br />Sec. 3 This permit is Sssued for a term of 5 years commencing oa the date the
<br />permit is signed by tha permittee, except that this permit ;till
<br />Germinate if the permittee has not begun the surface coal wining and
<br />reclamation operations covered herein within 3 years of the date of
<br />issuance.
<br />Sec. 6 The permie rights nay not be transferred, assigned, or sold without
<br />the approval of the Director, OSM. Request for transfer, assignment,
<br />or sale of permit rights must be done in accordance with 30 CFR
<br />740.13(e).
