Long <br />Division Direttor <br />This is in response to your letter of July 30, 1993 concerning the Pioneer Canon Drilling <br />Project. I have a copy of a letter dated July 27, 1993, from Golden Drilling to your <br />Company. The letter indicates 23tfz loads of fill material were used, according to the <br />agreement you made with the Contractor on Friday, July 23, 1993. The Division understands <br />that you required payment of $25.00 per truckload. <br />The Contractor's letter goes on to state that if the gate repairs are not to your satisfaction, <br />the Contractor will replace the gate. I sent a copy of your letter to the Contractor, and <br />discussed fence repairs and gate replacement with them. These repairs will be made as <br />soon as possible. <br />As to your contention .that the Division did not have permission to conduct the backfilling <br />activity on the subject property, I would refer you to the Consent for Right of Entry for <br />Reclamation Activities which you signed and notarized February 18, 1993. The document <br />states that .. "the undersigned hereby grants to the agents, employees, and contractors of the <br />Division of Minerals and Geology, ......permission to enter upon such lands to complete the <br />reclamation activity described on the attached "Work Narrative". The Work Narrative <br />attached to the document clearly states that "Several subsidence craters and two steaming <br />vents will also be backfilled during the project work". It is unclear to me how you can <br />construe that the Division was using your land without your permission, when we have this <br />permission in writing in our project files. <br />Si ely, <br />G~ K ~~ <br />Bruce IC.
