Drviswn Duraor <br />RE: GEC West Pit Reclamation <br />Dear Dr. Corley: <br />The Division received your letter of September 14, 1994. In your <br />letter, you posed two questions. One question related to the <br />remaining GEC bond money, and the other was in regard to <br />reconsidering the West Pit agreement because of sediment concerns. <br />The amount of GEC money available for further work is apparently <br />contingent upon resolution of pending disagreements between DMG and <br />the contractor who did the East Pit work. Therefore, it will not <br />be possible to say exactly how much money is available until those <br />issues are resolved. <br />In regard to your second question, we do not believe the West Pit <br />agreement should be reconsidered because of sediment control issues <br />being discussed at the Newlin Creek Mine. The proposed West Pit <br />work is an effort to reestablish pre-existing drainage conditions, <br />including channel stabilization measures. The runoff in this <br />channel will be routed into another man-made diversion structure <br />(the Magpie Creek diversion), not onto Southfield Mine's operations <br />area. <br />The Division agreed to your proposal to withhold $800 of the <br />Harrison Western money for the West Pit. It is not apparent why <br />completion of the West Pit work should be contingent upon the <br />amount of remaining GEC money or questions about handling outfall <br />from a culvert at the Newlin Creek Mine. <br />Kessler Reclamation and the Division are ready to proceed with the <br />work. The Division recently delayed the work to incorporate your <br />proposal of withholding the $800 into the agreement. Obviously, we <br />would prefer to have the revised agreement signed prior to telling <br />Kessler to begin work; however, we will need to have the work <br />commence soon if it is to be completed this construction season. <br />
