`J <br />• PERMIT N0. CO-0069 <br />PAGE 2 of 5 <br />• The portion of the lease areas permitted (the 775.6 acres) are <br />shown on the map in attachment 1. This area is situated approximately 20 <br />miles north of Loma, Colorado in the vicinity of mileage post 1 on Colorado <br />Highway 139. The railroad loadout area proposed to be permitted is described <br />as follows: <br />A tract of land located in Section 34 of Township 2 North, Range 3 <br />West of the Ute Meridian, and in Section 3 of Township 1 North, <br />Range 3 West of the Ute Meridian, Mesa County, Colorado, being <br />more particularly described as follows: <br />An irregular tract of land varying in width from 69 feet to 80 <br />feet and lying 8.5 feet southwesterly from the centerline of the <br />Denver and Rio Grande Western Railroad Company's I.C.C. Track No. <br />11A and extending northwesterly 3210 feet from a point opposite <br />Mile Post 464 plus 5080 feet. <br />Sec. 3 This permit is issued for a period of 5 years commencing on the <br />date signed by the permittee, except that this permit will <br />terminate if the permittee has not begun the surface coal <br />mining and reclamation operations covered herein within 3 years <br />of the date of issuance. <br />• Sec. 4 This permit may be renewed upon expiration for areas within the <br />boundaries of the existing mining and reclamation plan in <br />accordance with the Act, the approved Colorado State Program <br />and the Federal Lands Program promulgated by the Secretary of the <br />Interior at 30 CFR Chapter VII Subchapter D. <br />Sec. 5 This permit rights may not be transferred, assigned, or sold <br />without the approval of the Director, Office of Surface Mining, in <br />accordance with 30 CFR 741.25. <br />Sec. 6 The permittee shall allow the authorized representatives of the <br />Secretary, including, but not limited to, inspectors, fee <br />compliance officers and of the Colorado Mined Land Reclamation <br />Division, without advance notice or a search warrant, upon <br />presentation of appropiate credentials, and without delay to: <br />• <br />
