Mid-Term Review <br />Chimney Rock Mine <br />Introduction <br />This document presents the results of the Division's Midterm Review of Kaiser <br />Steel Resources' Chimney Rock Mine. This Midterm review was conducted to <br />fulfill the requirements of Rules 2.06.2(9), 2.06.3(4), 2.06.5(3), 2.06.7(5) <br />and 3.02.2(4) of the Regulations of the Colorado Mined Land Reclamation Soard <br />for Coal Mining. <br />Rule 2.08.3 requires that the Division conduct a review of each permit issued, <br />prior to its midterm. Based on this review, for food cause shown, the <br />Division may require reasonable revision or modification of the permit <br />provisions to ensure compliance with the Act and Regulations. <br />Rules 2.06.2, 2.06.3, 2.06.5 and 2.06.7 require that experimental practices, <br />mountain top removal variances, variances from AOC, and variances from <br />contemporaneous reclamation be reviewed by the Division where applicable <br />during the midterm review. None of these Rule designations apply to the <br />Chum ey Rock mining operation. Rule 3.02.2(4) requires that the division <br />review the amount of the bond and the terms of acceptance of the bond ever <br />2-1/2 years. <br />This midterm review consisted of a detailed review of the Chimney Rock Mine <br />application to identify any items that may have been overlooked during the <br />initial review. The Division also reviewea all subsequent revisions and <br />stipulation responses to ensure that all permit commitments and conditions <br />were being followed. Hydrologic monitoring data was reviewed in conjunction <br />with the review of the application to assess the adequacy of the monitoring <br />plan and discussion of hydrologic impacts. Problems and observations from <br />past inspection reports were also considered. <br />Those issues, deficiencies, confl icts, etc. identified by the Division as a <br />result of this review are noted in the following sections and require a <br />response by the operator. This response is to be made by April 15, 1991. <br />Where modifications of the permit application are necessary, these are to be <br />proposed by the operator in the form of a revision (or revisions) to the <br />permit and shall include updated Table of Contents or other indices, <br />narrative, calculations, maps, and/or exhibits in such form as to be suitable <br />for direct insertion into the permit application package when approved. <br />ction I -Comments <br />The Chimney Rock Mining operation was issued a five year mining and <br />reclamation permit, Number C-81-023, on January 7, 1983. The permit area was <br />expanded to allow mining of Federal coal adjacent to the original permit <br />through the submittal of Permit Revision No. 1, which was approved in January, <br />1984. A permit transfer from Chimney Rock Coal Company to Kaiser Steel <br />Corporation was approved by the Division in September, 1986. <br />-2- <br />
