Cottony <br /> Acting Division Director <br />Re: RAG-Empire, Eagle 5 & 9 Mine, C-81-044, Insurance Document <br />Mr. Mills: <br />The Division received RAG-Empire Corporation's proof of insurance certificate for the <br />Eagle 5 & 9 Mines (C-81-044). The insurance certificate covers the time period from July 1, <br />2002 through June 30, 2003. This document is in not in compliance with Rule 2.03.9. Please <br />state clearly which mine permit names and numbers this insurance document covers. <br />The certificate submitted on July 8, 2002, states that it applies to Colorado Yampa Coal <br />Company as well as RAG American "Hodling", Inc., RAG Empire Corporation, and Twentymile <br />Coal Corporation. The Division has approved final Phase III Bond Release on the Eckman Park <br />and Energy Mines 1 and 2 permit. The Division no longer requires maintenance of an insurance <br />policy for the Eckman Park and Energy Mines No. 1 and 2. Please include a rider to the policy <br />that complies with Rule 2.03.9(3) that states that the insurer will notify the Division of <br />substantive changes in the policy, including termination or failure to renew.
