Cattany <br />Division Director <br />Natural Resource Trustee <br />Division's records indicate that the Buena Vista pit is an active sand and gravel operation located in a <br />portion of Section 5, Township 14S, Range 78W of Chaffee County. The permit was issued in 1977 <br />from the Mined Land Reclamation Board (Boazd) for a permit area of 23.81 acres. Permits issued by the <br />Board are "life of mine" and do not have expiration dates. Dependent upon the extent of the deposit <br />mined and the rate of extraction, mining operations may last from only a few months to decades. The <br />permit may be revoked and the reclamation bond forfeited to the State of Colorado only by an action of <br />the Board. Revocation and forfeiture may occur due to an uncorrected violation of the Acts, the rules <br />and regulations, or the terms of the approved permit. Hardrock Paving and Redi-Mix is permitted to <br />mine the Buena Vista Pit and must adhere to the approved mining and reclamation plan or any <br />subsequent changes to the plan. <br />The Board's jurisdiction does not extend to land use decisions, visual or economic impacts, noise, traffic, <br />dust and other nuisances, or socioeconomic issues. Local government, through the local land use and <br />planning and permitting process, handles these issues. The Board and the Division do not have authority <br />in such matters. Likewise, impacts to air quality, threatened or endangered species, discharges into <br />waters of the United States and historic resource protections are regulated by agencies other than the <br />Board.
