(e) Buyer shall assume and agree to be bound by and take the Property subject to all govenmtental permits and obligations, including mined land reclamatton permits, bonding requirements, and environmental permits, and all leases covering the Property. (f) Upon completion of the purchase and sale under this Contract, Buyer shall waive and release any claims or causes of action that it has or may have against Seller far any environmental contamination of the Property. (g) Seller and Buyer represent that no broker is entitled to a brokers commission or finder's fee. In the event that any broker or finder perfects a claim for a commission or fmde~s fee, the party through whom the broker or finder makes its claim shall be responsible for said commission or fee and all costs and expenses, including attorney Sees, incurred by the other party in defending same. 16. TERMINATION. In the event this contract is terminated, all payments and things of value received hereunder shall be returned and the parties shall be relieved ol'all obligations hereunder. 17. NOTICE TO BUYER Any notice to Buyer shall be effective when received by Buyer. 18. NOTICE TO SELLER Any notice to Seller shall be effective when received by Seller. 19. MODIFICATION OF TffiS CONTRACT. No subsequent modification of any of the terms of this contract shall be valid, binding upon the parties, or enforceable unless made in writing and signed by the parties. 20. F.NT F A F..MENT. This contract constitutes the entire contract between the parties relating to the subject hereof, and any prior agreements pertaining thereto, whether oral or written, have been merged and integrated into this contract. 21. NOTICE OF ACCEPTANCE: COUNTERPARTS. This contract shitil be effective when signed by both Buyer and Seller, as evidenced by their signatures below., and both parties have received a copy of the other part}rs signature before June 20, 1994 at 5:00 p.m. A copy of this document tray be executed by each party, separately, and when each party has executed a copy thereof, such copies taken together shall be deemed to be a full and complete contract between the parties. ,.a.,..,.,9.
