Mount <br />Senior Environmental Protection Specialist <br />Mined Land Reclamation Board <br />Division of Minerals and Geology <br />1313 Sherman Street, Room 215 <br />Denver, CO 80203 <br />RE: Permittee: Platte Sand & Gravel, L.L.C., S & H Mine <br />Permit Number: M-2000-158 <br />Type of Permit: 112c <br />Permit Date: August 10, 2001 <br />Dear Mr. Mount: <br />Ceram <br />RECEIVED <br />MAY 0 5.2003 <br />fYuision ~f Minerals and Geology <br />The Mined Land Reclamation Board issued the above referenced permit to the Platte Sand & <br />Gravel, L.L.C., which was organized by Tom Sharkey and Krystal Hoffschneider, who own <br />properties west of Gilcrest and northwest of Platteville in Sections 23-T4N-R67W, 26-T4N- <br />R67W, 34-T4N-R67W, 35-T4N-R67W and in Section 2-T3N-R67W. <br />Tom Shazkey and Krystal Hoffschneider deeded their respective properties to the Platte Trust in <br />2002, and the Platte Trust deeded part of the Hoffschneider property back to 'Tom Sharkey. The <br />Platte Trust and Tom Sharkey also petitioned the Town of Milliken to annex their properties in <br />order to obtain a sand and gravel mining (USR) permit from the Town of Milliken and, thereby, <br />circumvent the Weld County Commissioner's denial of a mining permit to Platte Sand & Gravel, <br />L.L.C. on October 10, 2001. <br />In an annexation agreement, the Platte Trust and Tom Sharkey have stated that they will provide <br />the Town of Milliken with municipal water storage in the ponds that will be created by sand and <br />gravel extraction on their properties. Several of the adjoining property owners and I have <br />questions that we would like you to answer for us. <br />1. Can the property owners, Tom Sharkey and the Platte Trust, store water for municipal use in <br />the ponds that will be created as a result of sand and gravel extraction under the Platte Sand & <br />Gravel, L.L.C.'s current 112c permit, which we understand is for unlined ponds only? If not: <br />a. Will the property owners, Tom Sharkey and the Platte Trust, or the Platte Sand & <br />Gravel, L.L.C. be required to reapply for another permit or amend their current permit, <br />and go through the entire permitting process (including a protest or mitigation hearing) <br />again in order to store water for municipal use in said ponds, or <br />b. Can the necessary changes be made to the cun•ent permit through a technical revision <br />process in order for the property owners or the limited liability company to store water <br />for municipal use in said ponds? <br />
