McArdle <br />Senior Reclamation Specialist <br />Mined Land Reclamation Division <br />1313 Sherman Street, Room 215 <br />Denver, CO 80203 <br />Re: Settlement Agreement <br />Notice of Violation C-91-010 La Plata Mine <br />Dear Mr. McArdle: <br />JAN 0 2 1992 <br />F~o.,~ Mined Cand <br />The Firat National Bank of Florence, at the present time would <br />like to appeal the decision to the Board. <br />The Bank has had discussion, through our attorney, with Frank <br />Johnson of the Attorney General's office, and with Harry Ranney of <br />the Mined Land Reclamation Division with reference to this matter. <br />' At this time, it is the Bank's understanding, that the Mined Land <br />Reclamation Division and the Colorado Attorney General's office <br />'_ agree that if the Bank pays the $1,000.00, we only are respon- <br />~~ sible for the supervision of the site, making sure there is no <br />'?`C' more erosion and that the grasses planted take. <br />Upon receipt of a letter stating that this is in fact the case, <br />and that the Bank will not be held liable in any way for the con- <br />veyor that remains on the property, or for any damages the removal <br />of that conveyor may cause, we will then reconsider our position <br />-~ with reference to this civil penalty. <br />We still believe that the facts are very confusing, and that the <br />Bank's responsibility is not as clear cut as it might be in cer- <br />tain other instances, especially with the advice we were given <br />through the Attorney General's office. <br />Any assistance that you or your office may be able to provide in <br />order to expedite this matter will be greatly appreciated. <br />Sincerely <br />THE FIRS~I NATIONAL BANR OF FLORENCE <br />W.
